Messy Office Contest Official Rules
VOID WHERE PROHIBITED BY LAW. NO PURCHASE NECESSARY. THIS CONTEST WILL BE INTERPRETED ACCORDING TO THE LAWS OF CANADA AND IS SUBJECT TO ALL APPLICABLE FEDERAL, PROVINCIAL, TERRITORIAL AND MUNICIPAL LAWS |
Eligibility |
1. |
The "Messy Office" Contest ("Contest") is open to any individual legal resident of the United States or Canada, excluding the Province of Quebec, and the States of Florida, Rhode Island, New York and otherwise where prohibited by law, who is over the age of 21 years, except any officers, directors, principals, owners, partners, employees, agents or other authorized representatives, and members of their immediate families of Protus IP Solutions Inc. ("Contest Sponsor") and its respective affiliates, and advertising/promotional/PR agencies. Contest Sponsor reserves the right to verify eligibility qualifications of any individual entering the Contest ("Contestant") and to disqualify any Contestant found to be in violation of these Contest Rules. |
Contest Entry and Voting Periods |

The Contest entry period begins at 12:00 p.m. (EST) on January 21st, 2008 and ends at 12:00 p.m. (EST) on February 25th, 2008 ("Contest Entry Period"). The Contest voting period during which the public may vote for the entry of one of the Contest Finalists will begin at 5:00 p.m. (EST) on February 25th, 2008 and end at 12:00 p.m. (EST) on March 3rd, 2008 ("Grand Prize Voting Period"). |
How to Enter: |

Contestant must fully complete and submit an Entry Form found at: www.messyofficecontest.com/entry, and submit either a photograph or video depicting the Contestant's messy office. Instructions on how to submit the photo or video are outlined on the Entry Form. (The Entry Form and photo or video are collectively referred to herein as the "Contest Documents".) |
4. |
For an entry to be eligible, Contest Documents must be received electronically by the Contest Sponsor no later than 12:00 p.m. (EST) on February 25th, 2008. Only one (1) entry per Contestant will be accepted. Upon submission, all Contest Documents and their contents shall become the exclusive property of the Contest Sponsor, with the Contest Sponsor acquiring and retaining all rights, title and interest therein, including the right of ownership and copyright. The Contest Sponsor shall furthermore have no obligation to acknowledge receipt of or to return any Contest Documents received. |

NOTICE TO ONLINE ENTRANTS: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Contest Sponsor is not responsible for faulty, incorrect or mistranscribed phone/facsimile transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Contest Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. Contest Sponsor reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Contest Sponsor/judges/administrator, in their sole discretion. In the event of termination, a notice will be posted online and all eligible online entries received prior to termination will be included in the judging. If technical malfunctions or suspect voting/irregularities corrupt the voting process, Contest Sponsor reserves the right, in its sole discretion, to award prizes based solely on the Contest Finalists' Judging scores or non-suspect votes. Any damage made to the Web Site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries/votes will not be deemed to be proof of receipt by Contest Sponsor. Any use of robotic, automatic, programmed or the like methods of participation/voting will void all such submissions/votes by such methods. Contest Sponsor reserves the right to prohibit the participation/voting of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. |
Contestant Warranties and Consents |
6. |
By completing and submitting an Entry Form and/or any other Contest Documents, the Contestant:
(a) |
warrants and represents that |
(i) |
he/she has read, and agrees to be bound by, these Contest Rules, |
(ii) |
based on the Contest Rules, he/she is eligible to participate in the Contest, and |
(iii) |
all of the information provided as part of his/her Contest Documents is accurate, the written submission and images provided are the original work of the Contestant; may not have won previous awards; may not have been published previously; must not infringe third-party rights (including without limitation rights of privacy and publicity), and must be suitable for publication (i.e., may not be obscene or indecent) |
(b) |
Except where prohibited by law: |
(i) |
entry constitutes permission for Contest Sponsor to use Contestant's' photo or video, entry, name, hometown, likeness, photograph, voice and statements regarding this contest for editorial, public relations, promotional and advertising purposes in any media, including the Internet, for contacting potential Prize Winners and for any purpose whatsoever on behalf of Contest Sponsor without compensation; |
(ii) |
potential Grand Prize winners will be required to complete and return an Affidavit of Eligibility, Ownership and Release of Liability, Copyright Assignment and Publicity Release within 10 days of notification or the entry with the next highest voting score will become the alternate winner. |
(c) |
agrees that, if selected as the winner, he/she will be solely responsible for any and all expenses or charges incurred, as a result of, or relating to, his/her acceptance and/or use of a prize, including any resulting tax liabilities, and that none of the prizes awarded hereunder may be substituted or exchanged for other prizes (including cash), nor assigned, subleased or otherwise transferred by winner. |

Winning Prizes: |
7. |
There are three (3) types of prizes: (a) Ten (10) Contest Finalist Prizes, (b) One (1) Grand Prize and (c) Fifteen (15) Runner Up Prizes:
(a) |
Contest Finalist Prizes: Based on the Contest Judging Criteria, immediately following each week of the Contest, a panel of judges appointed by the Contest Sponsor will select from amongst eligible entries received that week of the Contest Entry Period two (2) "Contest Finalists", resulting in a total of 10 Contest Finalist Prizes (2 per week for 5 weeks); |
(b) |
Grand Prize: During the Grand Prize Voting Period members of the public will be able to vote online for one of 10 finalists to determine one (1) winner from among the Contest Finalists and award him/her the Grand Prize. Each individual is allowed to vote once for a single Contest Finalist Submission. Subject to these rules, the Grand Prize will be awarded to the Contest Finalist with the greatest number of votes from the public. |
(c) |
Runner up Prizes: Based on the Contest Judging Criteria, immediately following each week of the Contest, a panel of judges appointed by the Contest Sponsor will select from amongst eligible entries received that week of the Contest Entry Period other than those of the Contest Finalists, three (3), "Runner up Winners" per week and award him/her one(1) Runner Up Prize as set out below in section 9(c) below for a total of 15 prizes. |

Contest Judging Criteria: |

The judges for the Contest will select Contest Finalists and Runner Up Winners based on, in their sole discretion, the following criteria:
(a) |
Uniqueness and Ingenuity of Proposed Messy Office Solution: in written submission–25%, |
(b) |
Creative Filing and Storage options: photos and videos may capture fact that while there may be areas in which to contain the clutter, they are not being used for intended purpose: i.e. filing cabinets, drawers, storage bins, pen holders, paper trays, - 25% |
(c) |
Creativity and Artistic Merit: of photo/video depiction of total disorganization–50%. |

In the event of a tie, either in Judging Scores or online voting, tied entries will be broken based on the highest score for (c) Creativity and Artistic Merit.
Prizes: |
9. |
Contest prizes are as follows:
(a) |
ten (10) Contest Finalist Prizes comprised of (i) a US$200.00 Gift Certificate to Amazon's All Business Center and (ii) a Free "MyFax" account for one year (approximate retail value of the account is US$110.00). (Approximate retail value (ARV) of each Contest Finalist Prize is US$310); |
(b) |
one (1) Grand Prize of US$10,000 (ARV of the Grand Prize is US$10,000); |
(c) |
five (5) free MyFax accounts for one year (ARV of each account is US$110.00) and ten (10) US$100 gift certificates to Amazon's All Business Center (ARV of each certificate is US$100). |

The names of the winners will be announced on www.messyofficecontest.com by March 5, 2008. |
11. |
The awarding of any prize is contingent upon full compliance with these Official Rules; winner may be subject to other verification and eligibility requirements. Entrants agree to be bound by Official Rules and agree that if potential winner fails to provide proof of identity, refuses to provide a required affidavit, is found to have violated Official Rules or otherwise does not meet eligibility criteria, prize will be forfeited and awarded to the entry with the next highest score. |
Claiming prizes: |
12. |
Contest Finalist Prizes: A representative of the Contest Sponsor will attempt to contact each Contest Finalist as follows: using the email address and/or telephone number provided by a potential winner in connection with his/her entry, s/he will attempt to establish actual email or telephone contact with the Contest Finalist within two (2) business days following the date on which the person became the Contest Finalist. If the Contest Sponsor representative is unable to establish actual email or telephone contact with the Contest Finalist within that time period after at least three (3) attempts by the Contest Sponsor during normal business hours then the Contest Finalist may be disqualified and have no further claim against the Contest Sponsor with respect to that prize or any other matter in connection with the Contest. If a Contest Finalist is disqualified, an alternate Contest Finalist will be declared based on the Judging criteria from among the remaining pool of entries received during the week in question, and that Contest Finalist will also be subject to the above contact/disqualification process. |
13. |
Grand Prize: A representative of the Contest Sponsor will attempt to contact the Grand Prize winner as follows: using the email address and/or telephone number provided by a potential winner in connection with his/her entry, s/he will attempt to establish actual email or telephone contact with the Grand Prize winner within two (2) business days following the date on which the person became the Grand Prize winner. If the Contest Sponsor representative is unable to establish actual email or telephone contact with the Grand Prize winner within that time period after at least three (3) attempts by the Contest Sponsor during normal business hours then the Grand Prize winner may be disqualified and if so disqualified, will have no further claim against the Contest Sponsor with respect to that prize or any other matter in connection with the Contest. The alternate Grand Prize winner will be the Contest Finalist with the next largest number of votes from the online voting process described above, and that Grand Prize Winner will also be subject to the above contact/disqualification process. |
14. |
Runner Up Prizes: A representative of the Contest Sponsor will attempt to contact each Runner Up Prize winner as follows: using the email address and/or telephone number provided by a potential winner in connection with his/her entry, s/he will attempt to establish actual email or telephone contact with the Runner Up Prize winner within two (2) business days following the date on which the person became the. If the Contest Sponsor representative is unable to establish actual email or telephone contact with the Runner Up Prize winner within that time period after at least three (3) attempts by the Contest Sponsor during normal business hours then the Runner Up Prize winner will be disqualified and have no further claim against the Contest Sponsor with respect to that prize or any other matter in connection with the Contest. If a Runner Up Prize winner is disqualified, an alternate Runner Up Prize winner will be declared based on the Judging criteria from among the remaining pool of entries received during the week in question, and that Runner Up Prize winner will also be subject to the above contact/disqualification process. |
15. |
Prizes will be distributed by mail or email once all required documents under section 6.(b) (ii) above have been executed by Winners to the satisfaction of Contest Sponsor in its sole discretion. |
Personal Information and Privacy |
16. |
By entering the Contest and voluntarily providing his/her personal information, each entrant and/or his/her parent and/or legal guardian if applicable consent(s) and agree(s) to the Contest Sponsor's collection, use, and disclosure of the entrant's personal information for the purpose of administering the Contest, including contacting any entrant in relation to the Contest and disclosing the list of winners. The Contest Sponsor will not use an entrant's personal information for any purpose for which consent has not been provided herein and will not otherwise disclose it to any third party. |

Contest Sponsor Reserved Rights and Entrant Release: |
18. |
The Contest Sponsor reserves the right, in its sole discretion and without responsibility or liability therefore, to make all decisions concerning eligibility, which decisions shall be final and binding. The Sponsors reserve the right to substitute a prize of equal or greater value if for any reason a prize cannot be awarded as described. The Contest Sponsor also reserves the right, in its sole discretion and without responsibility or liability therefore: (i) to disqualify any Contestant, whom the Contest Sponsor determines to have been responsible for tampering with the Contest process or to otherwise be in violation of these Contest Rules; and (ii) to suspend, cancel or modify the Contest at any time in the event of any circumstances, which may prevent the Contest from proceeding as planned or which may adversely affect the administration, security, fairness or integrity of the Contest, including without limitation the process by which the winners are selected. |
19. |
By entering the Contest, contestants agree that (a) the Contest Sponsor shall not be responsible or liable for any losses or injuries of any kind resulting from participating in the Contest or acceptance, possession and/or use or misuse of any prize and agree to release, discharge and hold harmless the Contest Sponsor, along with their respective officers, directors, parent companies, subsidiaries, affiliates, related companies, advertising and promotional agencies and prize suppliers from all claims or damages arising out of contestants's participation in the Contest and/or acceptance, use or misuse of any prize; and (b) to execute a document in evidence of same as a condition for receiving any prize under the Contest. |
20. |
By entering the Contest, contestant agrees to assign all copyright contestant may have in any material provided to Contest sponsor in connection with the Contest and to waive any associated moral rights in connection therewith, and agrees to execute any further evidence of same as requested by the Contest Sponsor. |
Limitation of Liability: |
21. |
By participating in the Contest, the Contestant, for and on behalf of himself/herself, understands and agrees that the Contest Sponsor (including its affiliates, and the officers, directors, employees, principals, owners, partners, agents and other authorized representatives thereof) shall not be responsible or liable for: (i) misaddressed, lost, late, ineligible, incomplete or illegible Contest Documents; (ii) any injuries, losses, damages, taxes or expenses of any kind incurred as a result of Contestant's participation in the Contest or winning, accepting, taking possession of, or using any of, the prizes awarded hereunder; (iii) any printing or typographical error in any materials associated with the Contest, or human or technical error, which may occur in processing entries submitted in connection therewith; or (iv) any theft or destruction of, or unauthorized access to, or use or alteration of, any of the Contest Documents submitted hereunder. By participating in the Contest, the Contestant, for and on behalf of himself/herself, further agrees to fully and forever release and hold harmless the Contest Sponsor (including its affiliates, and the officers, directors, employees, agents and other authorized representatives thereof) from any and all losses, damages, rights, claims, actions, or expenses (including attorneys' fees and costs) of any kind whatsoever, in connection with the Contestant's participation therein, including without limitation personal injury, death, property damage, right of privacy, right of publicity, and defamation. |
List of Winners: The names of the winners will be announced on www.messyofficecontest.com by March 5 2008.
